1. About Lodgepath
Lodgepath (‘we’, ‘us’, ‘our’) operates the website lodgepath.com.au (the ‘Platform’). The Platform connects builders, architects, and developers (‘Clients’) with development approval consultants including private certifiers, town planners, hydraulic engineers, and other related professionals (‘Consultants’).
By accessing or using the Platform, you agree to be bound by these Terms of Service (‘Terms’). If you do not agree, please do not use the Platform.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform you represent and warrant that you have the legal capacity to enter into a binding agreement under Australian law.
Where you use the Platform on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
3. What Lodgepath does
Lodgepath is an introduction and referral service. We do not provide consulting, planning, certification, or any other professional services ourselves. When a Client submits a brief and we identify a suitable Consultant, we facilitate an introduction between the two parties.
Any engagement, contract, scope of work, fee arrangement, or professional relationship is formed solely between the Client and the Consultant. Lodgepath is not a party to that arrangement.
4. Posting a brief (Clients)
When you submit a brief through the Platform, you agree to:
- Provide accurate and complete information about your project and requirements
- Respond promptly if we contact you to clarify your brief or facilitate an introduction
- Not misuse the Platform to contact Consultants for purposes unrelated to the submitted brief
Submitting a brief does not guarantee a match or introduction. We will use reasonable efforts to identify a suitable Consultant based on your brief, but availability and suitability are not guaranteed.
5. Listing your services (Consultants)
When you submit a listing to appear on the Platform as a Consultant, you agree to:
- Provide accurate, truthful, and up-to-date information about your qualifications, accreditation, availability, and rates
- Hold all licences, registrations, and accreditations you represent yourself as holding
- Notify us promptly if your availability, rates, or professional credentials change
- Not misrepresent your qualifications, experience, or professional standing
All listings are subject to review and approval by Lodgepath before being published. We reserve the right to decline or remove any listing at our discretion.
6. Referral fee
Lodgepath charges Consultants a flat referral fee of $150 (AUD, inclusive of GST) per successful introduction that results in an engagement. A successful introduction means the Client and Consultant have made contact through a Lodgepath referral and agreed to proceed with work.
The referral fee is payable by the Consultant. Lodgepath will invoice the Consultant upon confirmation of the engagement. The fee is non-refundable once an introduction has been made.
By listing on the Platform, Consultants agree to pay the applicable referral fee when a successful introduction is made.
7. No professional advice
Nothing on the Platform constitutes professional advice of any kind, including legal, planning, engineering, or construction advice. The Platform is provided for general information and connection purposes only.
You should always conduct your own due diligence when engaging a Consultant, including verifying their credentials and suitability for your specific project.
8. Accuracy of information
We take reasonable steps to verify the accuracy of Consultant profiles before publishing them. However, we do not independently verify all information provided by Consultants and cannot guarantee the accuracy, completeness, or currency of any profile on the Platform.
Lodgepath is not responsible for any loss or damage arising from your reliance on information provided by a Consultant on the Platform.
9. Limitation of liability
To the maximum extent permitted by law, Lodgepath excludes all liability for any loss or damage of any kind arising from your use of the Platform or any introduction made through it, including but not limited to:
- Loss of revenue, profit, or anticipated savings
- Loss of data or business opportunity
- Any work performed or not performed by a Consultant introduced through the Platform
- Any dispute between a Client and a Consultant
Where legislation implies a warranty or condition that cannot be excluded, our liability is limited to the maximum extent permitted by law, and in any event to resupply of the relevant service or payment of the cost of having the service supplied again.
10. Indemnity
You agree to indemnify, defend, and hold harmless Lodgepath and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your breach of these Terms
- Any information you provide that is inaccurate or misleading
- Any dispute between you and another user of the Platform
11. Intellectual property
All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to Lodgepath and is protected by Australian intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.
By submitting content to the Platform (including a bio, profile information, or project description), you grant Lodgepath a non-exclusive, royalty-free licence to use, display, and distribute that content for the purposes of operating the Platform.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your personal information as described in the Privacy Policy.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising in connection with these Terms are subject to the exclusive jurisdiction of the courts of Victoria.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the ‘Last updated’ date at the top of this page. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
